Terms of Service

These Terms of Service govern your use of FairSplit, operated by FairSplit Inc. (“FairSplit”, “we”, “us”). Please read them carefully. Questions? Email hello@fairsplit.live.

1. Acceptance of terms

  • By creating an account or using FairSplit you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the service.
  • We may update these terms. Material changes will be communicated by email and in-app banner at least 14 days before they take effect. Continued use after that date constitutes acceptance.

2. Eligibility

  • You must be at least 18 years old and legally capable of entering a binding contract in your jurisdiction.
  • FairSplit is intended for co-parents and legal guardians managing shared child expenses. Use for any other purpose is not supported.

3. Account responsibilities

  • You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account.
  • You must provide accurate registration information and keep it up to date.
  • You must not share account access or impersonate another person.
  • Notify us immediately at hello@fairsplit.live if you suspect unauthorised account access.

4. Payments and fees

  • Pro plan: $9.99 USD per month per co-parenting pair. One parent pays; both receive full access.
  • Stripe processes all payments. ACH transfers: 0.8% capped at $5. Card payments: 2.9% + $0.30. These fees are charged to the paying co-parent.
  • FairSplit charges a 2% withdrawal fee for Free-plan recipients; Pro-plan recipients withdraw at no additional cost.
  • Subscriptions renew automatically. Cancel at any time from account settings. No refunds for partial billing periods except where required by law.
  • All fees are non-refundable unless FairSplit has failed to deliver the subscribed service due to our error.

5. Acceptable use

  • You may use FairSplit only for lawful purposes and in accordance with these terms.
  • You must not submit fraudulent expense requests, falsify receipts, or attempt to misrepresent co-parenting financial obligations.
  • You must not attempt to reverse-engineer, scrape, or interfere with the service.
  • You must not use FairSplit to harass, threaten, or abuse your co-parent.
  • Violation of these rules may result in immediate account suspension without refund.

6. Your data and content

  • You retain ownership of all content you submit — receipts, expense records, messages, and calendar events.
  • By submitting content you grant FairSplit a limited licence to store, process, and display it solely to provide the service.
  • You can export or delete your data at any time. See the Privacy Policy for retention details.

7. Limitation of liability

  • FairSplit is a financial tool, not a legal service. Nothing in the app constitutes legal advice. Consult a qualified family law attorney for advice specific to your situation.
  • Court-ready PDF exports are designed to support legal proceedings but admissibility is determined by courts. FairSplit makes no guarantee of admissibility.
  • To the maximum extent permitted by law, FairSplit's total liability for any claim arising from use of the service is limited to the amount you paid in the 3 months preceding the claim.
  • We are not liable for indirect, incidental, special, or consequential damages including lost data, lost profits, or legal outcomes.

8. Service availability

  • We aim for 99.5% monthly uptime but do not guarantee uninterrupted access. Planned maintenance will be communicated in advance.
  • We reserve the right to modify or discontinue features with reasonable notice.

9. Termination

  • You may delete your account at any time from account settings. Your data is retained for 90 days to allow reactivation, then permanently deleted.
  • We may suspend or terminate accounts that violate these terms, with or without notice depending on severity.

10. Governing law

  • These terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles.
  • Disputes will be resolved by binding arbitration under the AAA Consumer Arbitration Rules, except that either party may seek injunctive relief in court for intellectual property or confidentiality matters.
